These Terms and Conditions govern your access to and use of the LEAKaware website, materials, and services. LEAKaware is a trading name of Altered Carbon Ltd (“we”, “us”, “our”), a company based in the United Kingdom. By using our website or engaging with our services, you agree to these Terms.

5. Trials, pilots, and subscriptions

  • Any pilot or evaluation is provided on a time‑limited, as‑is basis for assessment only.
  • Subscriptions, pricing, and service levels (if applicable) will be set out in an order form or commercial agreement with you.
  • We may update non‑material aspects of the services (including algorithms and interfaces) to improve performance, accuracy, or usability.
 

6. ROI tools and informational materials

  • ROI calculators, case studies, and guidance are illustrative and based on stated assumptions. They do not guarantee results and should not be relied upon as financial or legal advice.
  • Compliance support information (e.g., references to Awaab’s Law) is provided for awareness only. You remain responsible for your own compliance decisions and actions.
 

7. Intellectual property

  • We or our licensors own all intellectual property rights in the website, software, sensor firmware, algorithms, SporeScore®, trademarks, graphics, and other materials.
  • You must not copy, modify, or create derivative works from our content unless expressly permitted in writing.

  • Reverse engineer, decompile, or otherwise derive source code from our software or devices;

  • We may link to third‑party sites or use third‑party processors to deliver functionality (e.g., email delivery). We are not responsible for third‑party sites or their terms.

  • If we exchange non‑public information with you for pilots or commercial discussions, each party will protect the other’s confidential information and use it only for the agreed purpose.

  • For other processing (e.g., contact forms, customer accounts), we will only use your data for the purposes for which it was provided, apply appropriate security, and respect your rights under UK GDPR.

12. Newsletter & GDPR (UK)

  • Purpose & data collected: If you subscribe, we process your email address (and any optional details you submit) to send LEAKaware news, product updates, research, and events.
  • Legal basis: Consent (UK GDPR Art. 6(1)(a)). You can withdraw consent at any time using the unsubscribe link or by emailing support@leak-aware.co.
  • No selling or sharing: We do not sell or share your personal data with third parties for their marketing.
  • Processors: We may use trusted email providers solely to deliver and manage the newsletter under appropriate data processing agreements.
  • International transfers: If data is transferred outside the UK, we will use lawful safeguards (e.g., adequacy decisions or standard contractual clauses).
  • Retention: We retain your email until you unsubscribe or request deletion; we will delete upon request to support@leak-aware.co.
  • Your rights: Access, rectification, erasure, restriction, portability, and the right to withdraw consent. You may also complain to the UK Information Commissioner’s Office (ICO).
  • No minimum age requirement: We do not set a minimum age for subscribing, but where applicable you should have authority to provide the email address used.

14. Warranties and disclaimers

  • Except as expressly agreed in a signed contract, the website and any pilots/evaluations are provided “as is” and “as available” without warranties of any kind.
  • We do not warrant uninterrupted or error‑free operation, nor completeness or accuracy of site content.
 

15. Limitation of liability

  • Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under law.
  • Subject to the above, we shall not be liable for: loss of profit, revenue, data, goodwill, or any indirect, special, or consequential loss.
  • For paid services, our aggregate liability arising from or relating to the services will not exceed the total fees paid by you to us for the affected services in the 12 months before the claim.
 

16. Suspension and termination

  • We may suspend or terminate access where reasonably necessary (e.g., security risk, legal requirement, breach of these Terms).
  • You may stop using the website at any time and may end any subscription in accordance with your order terms.
 

17. Governing law and jurisdiction

  • These Terms and any non‑contractual obligations are governed by the laws of England and Wales.
  • The courts of England and Wales will have exclusive jurisdiction, except that we may seek injunctive relief in any competent jurisdiction.
